Соціально-правовий захист сімей загиблих та зниклих безвісти військовослужбовців в Україні

Abstract

Досліджувалися теоретичні та практичні аспекти організації соціально-правового захисту родин захисників і захисниць України, які загинули або зникли безвісти за особливих обставин. Об’єкт дослідження – сім’ї загиблих та зниклих безвісти військовослужбовців як суб’єкти отримання державних соціальних гарантій та послуг. На основі аналізу національного законодавства та судової практики розкрито ключові аспекти нормативно-правового регулювання соціальних пільг і виплат в Україні. У ході дослідження визначено правову основу та особливості юридичного статусу членів сімей загиблих і зниклих безвісти захисників. Охарактеризовано механізми міжвідомчої взаємодії у процесі оформлення статусів та реалізації соціальних виплат. Проведено оцінку технологій психосоціальної підтримки, зокрема специфіки роботи з горем та синдромом невизначеної втрати. Основну увагу приділено шляхам удосконалення діючої системи соціально-правового захисту в умовах воєнного стану, враховуючи провідний міжнародний досвід.

The thesis explores the theoretical and practical aspects of organizing socio-legal protection for the families of Ukraine's defenders (both male and female) who have fallen or gone missing under special circumstances. The object of the study is the families of fallen and missing servicemen as subjects of receiving state social guarantees and services. Based on the analysis of national legislation and judicial practice, the key aspects of the regulatory and legal framework governing social benefits and payments in Ukraine are disclosed. In the course of the research, the legal basis and specific characteristics of the legal status of family members of fallen and missing defenders are determined. The mechanisms of inter-agency cooperation in the process of status registration and implementation of social payments are characterized. The study evaluates psychosocial support technologies, particularly the specifics of working with grief and ambiguous loss syndrome. Primary attention is paid to the ways of improving the current system of socio-legal protection under martial law, taking into account leading international experience.
